1. License Grant

MindPen (“we,” “us,” or “our”) grants you a non-transferable, non-exclusive license to use the MindPen mobile app (the “App”) on your devices in accordance with this agreement. Your license is for personal use only. The App is licensed, not sold.

2. Use Restrictions

You may not:

• Copy, modify, reverse-engineer, or create derivative works of the App, except where permitted by law.
• Distribute, sublicense, or make the App available to multiple devices at the same time.
• Remove or circumvent security or authentication features.

3. Data Collection and AI Services

The App may process data using AI services (including OpenAI) to provide transcription, text transformation, or other requested features. We only collect and transmit the minimum data necessary to provide these features. By using the App, you consent to the collection and use of your data as described in our Privacy Policy.

4. Subscriptions and In-App Purchases

Some features may require subscriptions or in-app purchases. All purchases are processed via Apple App Store or Google Play. You agree to follow all applicable terms of use for these platforms. Subscription management, including cancellation, must be done through the store where the purchase was made.

5. Termination

This EULA is effective until terminated. We may terminate your license immediately if you violate any terms. Upon termination, you must delete the App from your devices.

6. Third-Party Services

The App may provide access to third-party services. You agree to use such services at your own risk. We are not responsible for content, accuracy, or availability of third-party services.

7. Disclaimer of Warranties

The App and any services are provided “as-is” and “as available.” We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
